GENERAL TERMS OF PARTICIPATION IN THE SERVICES AND PROGRAMS OF 'DREAM PLAN TOURS & TRANSFERS' INCORPORATING THE CONTENTS OF PRESIDENTIAL DECREE 7 / 2018, PURSUANT TO DIRECTIVE EE 2015 / 2302
The General Conditions of Participation (GOC) regulate the responsibilities and obligations on the one hand of the Customer (Traveler) who participates in an organized trip (package of travel services of transportation and at least one overnight stay), on the other hand of the Travel Agency (the Company) that sells travel packages (Trip) organized by itself or another organizer. The Traveller, the members of his family or not and the participants, through clubs, schools, companies, agencies or other entities, with their participation or mediation in the trip of the Company or another organizer, it is taken for granted that they unconditionally accept the trip program and the following G.O.S., which they have carefully studied, understood, accept and undertake to observe as a condition of their participation. The information, data and recommendations contained in the G.O.S have been checked by the Company for their validity and accuracy, are of a general nature and apply as they are, unless otherwise stated in the itinerary. The programs, including the applicable price list at any time, are valid for the period indicated in them. The information and details of the travel programs are subject to change due to frequent and extraordinary changes in conditions worldwide, especially in transportation and international relations. In this case, the Customer will be notified in time in the most convenient way.
1. OUR COMPANY AS ORGANIZER - GENERAL TOURISM OFFICE
Our company 'DREAM PLAN TOURS & TRANSFERS' has received a Special Operating Mark of the E.O.T with number MH.TE. 0206E70000887501 and organizes trips, itself or in collaboration with other organizers, which it sells itself or through another tourist agency, acting as an intermediary between customers / travelers and the various service providers it uses (transport companies, hotels, local travel agencies etc.), over which it does not have direct control, but provides the Client with all support in case of asserting any reasonable claim against the Mediator. The Agent is a travel reseller and is not a representative of the Company.
2. REGISTRATIONS - PARTICIPATION IN ORGANIZED TRIPS
Valid travel registrations and seat reservations are made via e-mail, fax, telephone and through our website, provided that, in order to reserve seats on each trip:
1st: advance payment equal to 50% of the total cost of the trip or (pre)payment of the entire amount in cash or by credit card or by remittance to the Company, within 48 hours, from the submission of the application for participation in the trip and
2nd: the unconditional acceptance and compliance with these G. O. S. For valid registration, the code of the specific trip, with the departure and return dates and any other distinctive elements of it. The right to participate in the trip is guaranteed by the payment of its entire value and related charges ten (10) full calendar days before departure. Any non-payment of the entire value of the trip within the stipulated time entitles the Company to cancel the reservation and, if necessary, to demand cancellation fees, in accordance with the cancellation conditions provided herein. The contracting party, who represents his family or group, has the obligation to inform all his fellow travelers represented by him about the details and conditions of the trip. Participants through a third party have the same obligations as the representative who signed them up for the trip, and the Company makes available to them any relevant information, whenever requested. On some organized air tours, a representative of the Company will be at the airport of departure / arrival to facilitate travel, while the escort will be at the airport of arrival and the services begin and end with the arrival and departure from / to the destination airport of the tour . The Company is not responsible for the days and hours of operation of markets, museums and archaeological sites.
3. TRAVEL PRICES - CHARGES
The prices of the trips mentioned in the applicable form of the Company are calculated on the day the price list / relevant form is issued, based on the cost list of the services provided, the applicable fares / surcharges, of all kinds, the exchange rate of foreign currencies with the Euro, as and any other cost factor. The Company, after having exhausted all possibilities of prediction, reserves the right to readjust the prices, when the above cost factors change due to extraordinary and unforeseeable increases or when the exchange rate of the foreign currency changes with the Euro to the detriment of the Euro before the departure of the trip. In the event that the value of the trip increases for the above reasons, the Traveler has the right to accept the corresponding increase or to cancel his participation, without incurring any cancellation fees. If the increase exceeds 10% of the total value of the trip, the Traveler has the right to request that the money he has given as an advance or the equivalent of the payment of the trip be returned free of charge. The same condition also applies in case of reduced participation (under 15 people) in the trip, which gives the right to the Company to cancel its operation. Child rates - discounts for minors, up to eleven (11) years of age), vary and apply when two (2) adults who are guardians of the minor and exercise parental care and/or guardianship over him or her normally pay in the same room / stateroom. The Company has the right to discount pre-registration or make available "last minute" seats, in order to make the trip, without the right of the other travelers to demand a similar discount. The prices do not include the municipal tax (where applicable), which applies only to visitors (tourists) and is paid on site at the hotels.
4. OBLIGATIONS - RESPONSIBILITIES OF THE TOURIST OFFICE (COMPANY)
The Company has an obligation to coordinate and execute in the best possible way the trips available to the Travelers, mediating between the travelers and any third party that provides the services (carriers, hoteliers, agents, etc.), it does not, however, have cannot have direct control over them, in which case it cannot be held responsible towards the Traveler for incorrect acts or omissions of third parties or partners or employees or additional persons other than third parties that may result in causing an anomaly in the provision of services, nor can it be held liable towards the Traveler due to damage to health or loss of human life or objects as a result of extraordinary situations or cases of emergency or force majeure, such as cancellations, delays or changes in the itineraries of means of transport (planes, ships, cars , trains, etc.), the blockade of areas due to strikes and / or sanitary conditions, due to acts of terrorism, due to war and / or hostilities, due to earthquake, due to hijacking and due to unforeseeable, sudden and extreme weather conditions and other causes that constitute force majeure, based on the provisions of Greek Jurisprudence. Therefore, given the possible minor or major delays due to technical reasons or due to a sudden, unforeseeable change in weather conditions, travelers are strongly advised to avoid scheduling meetings or visits for social or business reasons on the days of travel / flights. In such a case, the Company must exhaust all means of assistance for the continuation of the journey or the repatriation of the travelers, without responsibility or financial burden thereof, but entirely at the expense of the travelers. Travelers in the region are advised to be at the point of departure one day in advance in order to deal with possible route changes or other emergency problem. In cases of faulty service provision, an immediate report should be made to the escort and if no escort is provided, to the local agent with notification to the Company, so that the problem can be rectified. Otherwise, the problem should be reported in writing to the Company within ten (10) calendar days of the completion of the travel program, attaching each item for its justification. The possible compensation of the traveler for the improper provision of services cannot exceed twice the value of the individual service. Minimum participation for any trip is fifteen (15) adult people. If this number is not filled, the Company has the right to cancel the trip, informing the Travelers at least seven (7) calendar days before the start of the trip and returning the money they had paid either for an advance payment, or for full payment, without other liability, unless the travelers agree to bear the monetary difference resulting from the reduced participation. The value of the trip is considered to be that stated in the sales contract (receipt of payment for the trip), which is signed and accepted by the Traveler or Intermediary. The final travel plan is considered the one that the Traveler or Intermediary receives and accepts, with the attached travel information documents, two (2) – three (3) days before departure, incorporating any extraordinary changes that the Company is obliged to notify to the group that will join the trip. Services that are not mentioned in the descriptions of the programs of the organized trips or that are mentioned as optional, are either not offered at all by the Company, or are available at an additional charge, in addition to the listed prices, if it is finally possible to implement them. The Company is not responsible for any optional events, which are carried out by the local bodies. After the completion of the trip, the Company is obliged to issue and send to the declared e-mail address of the traveler the tax document provided for by the Law.
5. OBLIGATIONS - RESPONSIBILITIES OF TRAVELERS
In the context of organized trips, decent social behavior is necessary, complete compliance of the travelers with the travel program and the instructions of the escorts or guides, as well as their timely arrival at the meeting points for the various services of the program (flights, transfers, guided tours, excursions, meals, etc.) If as a result of delay or inconsistency of the traveler caused by his negligence or miscalculation of time or an illness that was treated invasively or conservatively or his involvement in an accident, the Traveler missed a flight or an intermediate destination within of the journey or intermediate - road or air or ferry or rail - movement or any service, the traveler is entitled to rejoin the group at his sole responsibility, care and expense, without the right to a refund for the service lost through his fault by any carrier or hotelier or other service provider, nor is he entitled to claim from the Company any amount as compensation or unduly paid for part or all of the journey, if reconnection is not possible due to time constraints in relation to the time of completion of the trip or is unprofitable due to excessively high costs. However, the Company undertakes to assist the Traveler, without having any obligation to do so, for the latter to claim from carriers, hoteliers and other service providers the return of part or all of the money attributable to a lost service only if the providers agree to proceed in compensation based on the presentation of supporting documents that the Traveler will be asked to provide. In order to deal with similar situations, it is recommended that the Traveler, before starting the trip, has taken out an insurance contract to cover the risks that may arise from his involvement in any of the above incidents. However, the company undertakes to make every possible effort to assist him, without having or assuming any obligation to this end. At airports, ports, stations, etc. the Traveler must be at least two (2) hours before the scheduled departure. If there is no accompanying person on the trip, the Traveler must confirm on the spot the next flights or other itinerary with the transport company and confirm what time and from which airport, port, terminal, station, etc. his journey takes place. Any loss of the means of transport due to the Traveler's delay or interruption of the trip resulting from a conscious decision of the same, entails the termination of the entire trip. In any case, it is up to the Traveler himself to decide whether he wishes to be reunited with the rest of the group, in principle with the help of the company, but, in any case, at his own expense and if reconnection is objectively possible, Any movement of the traveler outside the group is solely and entirely borne by him.
If the Traveler is unable to participate in the trip, while he has paid an advance or has fully paid the value of the trip, he has the discretion to assign his participation to a person of his choice who will unconditionally adhere to the terms and conditions of participation in the specific trip, the no later than six (6) working days before departure, while especially for sea transport the above deadline is ten (10) working days before departure. In the event of any outstanding balance of the value of the trip or any additional expenses arising as a result of the assignment, the Assignor and the Assignee are jointly and severally liable towards the Company for the payment of the remaining amount. Especially for the case where the trip includes air transportation of the Traveler, it is pointed out that it is not possible to change the name of the Traveler as an air passenger, in which case, alternatively, the Traveler may cancel the original reservation and, after consultation with the Transferee, to seek a new reservation in the Transferee's name, subject to availability and provided that the Transferor and Transferee are willing to pay any additional amount requested as a charge for the new reservation. In this case, the Company bears no responsibility if a new reservation in the name of the Transferee is not possible, and any need to obligatorily cancel the reservation is governed by the cancellation conditions mentioned herein.
6. TOURS - EXCURSIONS - MUSEUMS - OPTIONAL
On national holidays, public holidays, semi-holidays and statutory holidays or in the event of a declared strike or work stoppage of the employees of museums or archaeological sites just before the start or after the start of the trip, the Company bears no responsibility if the visits to museums and archaeological sites places do not take place or, if possible, take place on a different day and / or time than the scheduled one. The price of the trip does not include entrance fees to museums, archaeological or related places of interest, unless otherwise specified in the trip program. In the optional guided tours / excursions and events that are decided, organized and paid for in a foreign country, a minimum number of participants is required. In the event that the minimum number of travelers is not met, i.e. in the event of cancellation of the optional tour, excursion or event, the Company bears no responsibility for this development, nor is it responsible if, due to the reduced participation in an optional tour, excursion or event, the payment of a price that is higher than expected. In any case, the carrying out of an optional guided tour, excursion or event and the participation in it of any traveler is at the absolute judgment and discretion of the travelers, and the program and duration of the guided tours and events in general are determined by the tourism agencies and the agencies that conduct guided tours in every place of a foreign country.
7. HOTELS - ACCOMMODATIONS / SHIPS AND OTHER MEANS OF TRANSPORT
All the information regarding the categorization or classification of the hotels and tourist accommodations mentioned in the programs of the organized or sold trips of the Company are in accordance with the applicable legislation of each state. The double rooms of most hotels accommodate two single beds or a semi-double. Triple rooms are, in essence, double rooms, that is, they have two single beds or a semi-double with an extra bed, which, usually, is not particularly comfortable and can be smaller than normal or be a sofa or a folding bed. The rooms are delivered by the hotel to the Traveler usually between 14:00 - 15:00 pm. and is available to tenants until 12:00 pm on the day of departure. In the event that the Traveler wishes to enter the room earlier or depart later, if such possibility exists, he must bear the additional cost. If, due to an unforeseen necessity, the organizer of the trip is forced to change the hotel to another hotel of the same or higher category, the Company does not owe compensation to the Travelers for this reason. In case of late arrival of a Traveler at the hotel, after the day or time of his scheduled arrival, if he has not informed the hotel and the Company accordingly, the hotel has the right to cancel the reservation and make the room available to a third party for the entire period of the reservation, if requested. In the event of overbooking on the part of the hotel, the Company undertakes to make every possible effort to settle the matter, in accordance with the laws in force in the host country. All the accommodations used by the Company have a legal and valid operating license from the competent authorities of the country where they operate. The selection of the rooms of any hotel is based on the criteria of their location, the services they offer and the comforts they provide to the Traveller, in combination with the selling price of the trip. To determine the above, there is no single criterion that is internationally accepted, therefore there may be differences between hotels regarding the services they offer and the amenities they provide, regardless of whether they belong to the same category. Most hotel rooms are made for two single beds or a semi-double bed. Therefore, triple or quadruple rooms are essentially double rooms with an extra bed or beds and subject to the restrictions mentioned above. In the event of overbookings on the part of the hotel, both it and the Company must make every effort to accommodate the travelers, in accordance with the regulations in force in the host country. On trips that take place within the Greek territory and provide for the road transport of Travelers by coach buses, seats are allocated based on the order of registration and do not change during the trip. In contrast, on trips to foreign countries involving road transport by coach bus, the seats change daily. The duration of a full-day tour / excursion does not exceed twelve (12), in total, hours, of which the duration of driving cannot exceed eight (8) hours, while the remaining four (4) hours are considered waiting time, in accordance with the existing legislation and jurisprudence of the Greek courts. The calculation of the above-mentioned total duration of twelve (12) hours starts from the time of the bus's departure from the hotel and is completed at the time of its final (and not intermediate) return to the hotel. It is made known to the Travelers and it is expressly agreed that the airlines several times, for a reason that does not concern the Company, such as, for example, the case of damage to an aircraft, sometimes charter for their flights airplanes of another airline and / or of a different type from expected or change flight schedules, from any to any time during the day. These changes are accepted by IATA and do not constitute a valid reason for the cancellation of the trip by any Traveler, and any cancellation of the trip may be subject to cancellation fees, which are borne entirely by the Traveler.
8. PASSPORTS - ENTRY VISAS (VISAS) - HEALTH FORMULATIONS.
All participants in foreign trips are required to have a new type of passport that has been issued no later than ten (10) years before the agreed date and time of the end of the trip. In countries that are subject to the Schengen Agreement, any Traveler who is a Greek citizen can travel using his/her identity card, as long as it is of a new type and his/her personal information is also written in Latin characters. The Company recommends to travelers that the expiration date of their passport extends at least six (6) months after the end of their trip. Certain destinations require, in particular, that the expiry date of the travelers' passport extends at least three (3), six (6) or twelve (12) months after the end of their trip. The period for the timely visa (visa) has been included by the Company in the deadline for declaring participation in each excursion, as well as the health formalities, if they are required. The issuance and duration of validity of all travel documents (passport, identity card, etc.) is the sole responsibility of the Traveler and the Company bears no responsibility in the event that the Traveler does not have time to issue or renew the validity of any travel document that is necessary for his participation in the Trip. Special attention needs to be paid to minor travelers who must necessarily be provided with the required travel documents (passports, etc.). Also, Travelers who hold passports of foreign countries must inform the Company in writing and know that they must contact, at their own risk, the consular authorities of their country, as well as of the countries they will visit, in order to check if they need entry visa (visa) or any other travel document for the countries they will pass through or in which they will stay during their trip, as well as for their re-entry into Greek territory. Any failure to ensure the timely issuance or visa of the necessary travel documents is not a valid reason for canceling the traveler's participation in the trip. If, immediately, the Traveler proceeds to cancel the trip, he will be charged in full with the cancellation fees. The Company provides travelers with all travel information where the International Health Organization requires vaccination, medication, etc. However, due to the frequent local epidemic changes and the medical personal data of each Traveler, he has the responsibility to contact the competent local health authorities for more responsible and valid information or to his treating physician, knowing that he will be traveling to areas extreme conditions in terms of epidemic crises, extreme temperatures (heat - cold, altitude or other similar conditions.
9. INSURANCE
The Company has concluded a Civil Professional Liability insurance policy for each trip it organizes, which covers the cases of any liability towards its customers, resulting from the non-execution or defective execution of the organized trip. Also, the insurance policy covers the case of insolvency or bankruptcy.
In any case, the Company strongly recommends that travelers take out an insurance policy that covers travel accident insurance, medical/hospital expenses due to hospitalization as a result of an accident, loss or delay of luggage, travel acceleration costs, repatriation of a traveler as a result of injury or illness, possibly further optional coverages, as well as coverages intended to be provided for people who have exceeded the age of 75, against insurance amounts set by each traveler at his discretion and desire, but also at his absolute discretion. In case of illness of a traveler during a trip within a country of the European Union, the Company recommends that the Traveler contact the Insurance Company for the issuance of the "European Illness Insurance Card".
10. LUGGAGE
Baggage is transported under the responsibility of its owners, delivered to the carrier and received under the responsibility and care of its owners, regardless of whether or not there is an escort from the Company. In case of damage or loss of any Traveler's luggage, the IATA Regulations for the carriage of luggage by air and the corresponding international Conventions for their transport by another means of transport shall apply, while the corresponding international Conventions shall apply for the loss of luggage within the traveler's hotel , and there is a limitation of the liability of the entity involved in compensation in any case, in accordance with the content of the international Treaties. The Company bears no responsibility for the contents of lost luggage and any valuables and valuables that it wanted to prove were inside the luggage and for this reason the Company recommends travelers to take out an insurance contract against the risk of losing luggage or valuables before the start of the journey. Regardless of whether the trip includes air, sea or road transport, the transport company undertakes the transport, for each traveler, of only one suitcase of normal size and weighing up to twenty (20) kilograms, unless otherwise provided (e.g. in domestic flights within the USA, where there is a charge per bag). In addition to luggage, each traveler is entitled to bring a small piece of hand luggage with maximum dimensions of 50 x 40 x 25 centimeters (length / height / width). If the traveler's luggage exceeds the maximum allowed weight or is more than the prescribed maximum number of pieces, the carrier reserves the right to impose an additional charge, which the traveler is obliged to pay on the spot, while the carrier may impose a restriction on the carry pieces of luggage.
11. CANCELLATIONS
In case of cancellation by the Traveler, cancellation fees and/or envelope costs are due depending on the time that elapses between the submission of the request for cancellation and the start of the trip, unless otherwise provided for each trip. Cancellations are made only in writing to the Company, and the charges per person, if it is not possible to assign the reservation to another person, are as follows: • Before 21 days from departure, the charge amounts to € 30 for trips within Greece and to € 50 for trips abroad per person, • Before 20 days and up to 14 days before departure the charge amounts to 40% of the total value of the trip. • Before 13 days and up to 7 days before departure the charge amounts to 60% of the total value of the trip. • Before 6 days before departure and until departure (non-show) the charge amounts to the total (100%) of the total value of the trip. In special air fares, when the ticket is purchased and canceled, the traveler is charged a charge up to the same amount (100%) of its total value, regardless of the time that elapses between the time of booking or payment of the ticket and the time of submitting the cancellation request of the journey. For the cancellation of a cruise, the conditions stated in the contract of each cruise company for each voyage - cruise, which the Company makes available to each traveler, apply. For individual / individual trips, different conditions apply in case of submitting a cancellation request. The charges of the surcharges, in case of submitting a request for cancellation, are imposed regardless of the time that elapses between the registration or repayment of the value of the trip and the start of it. In the event that one of the two people who are going to stay in a double room cancels their participation, apart from cancellation fees, due to the fact that the traveler will necessarily stay in a single room, he will be charged the difference in the charge between half the value of the double room and the charge for the use of a single room. Also, the canceling traveler is charged the equivalent of the value of their participation in any conference, match tickets and the cost of various services they have requested, and refunds due to cancellation are usually impossible, if not very rare. It is particularly pointed out to Travelers that during the Christmas, New Year, Epiphany, Shrove Tuesday, Easter, Holy Spirit, July-August summer holidays, all three-day holidays in general, as well as in the event of conferences , sports, artistic and other related events, organizations and movements, due to prepayments of fares, accommodation, tickets and other services provided, cancellation fees may reach a percentage of up to 100% of the total value of paid fares, accommodation, tickets and other services provided, regardless of the booking time for participation in the trip and the time of submitting the request for cancellation,
12. SETTLEMENT OF DISPUTES.
The Company and the Traveler undertake to resolve in good faith any dispute that may arise from the execution of the contract of the organized trip, as well as from the interpretation and/or application of any of the terms herein. In case of inability to find a solution according to the above, the parties undertake to address the Friendly Dispute Resolution Committee of the Association of Tourist and Travel Agencies in Greece and request its mediation for the out-of-court settlement of the dispute. Finally, in the event of failure of the above procedure for amicable resolution of the dispute, it is hereby agreed that the Courts of Athens will be competent and Greek law will be applicable.
The Traveler declares that I have carefully read the contents of all the above terms, which I fully understand and which I expressly, categorically and unconditionally accept for myself individually, but also on behalf of all travelers mentioned in my booking and I am authorized - / s for their registration on this trip.
